GENERAL TERMS AND CONDITIONS

The terms and conditions described here apply to all services, voyages and land programs contracted with JAHUAPACHA S.A. and/or ANDANDO TOURS. These general terms and conditions also apply to any third party services sold by JAHUAPACHA S.A. and/or ANDANDO TOURS. The user of the services provided by JAHUAPACHA S.A. and/or ANDANDO TOURS must comply with the terms and conditions described here in and any update published in the www.jahuapacha.com website under the section "GENERAL CONDITIONS," which will supersede any others. It is understood that the user of the services of JAHUAPACHA S.A. and/or ANDANDO TOURS declares to have read and understood this section and that he/she explicitly accepts these general conditions.

PRICES:

The fares included in our price list are valid until December 31 of the year in which they were hired and include only the services specified within them. Some price exceptions during the low season and/or special discounts may apply. The commission for travel agencies will be negotiated directly with each agency. JAHUAPACHA S.A. and/or ANDANDO TOURS reserve the right to change/modify the fares in case of events of high incidence to our costs, such as an increase in oil prices and/or significant fluctuations in taxes and/or substantial changes in labor conditions and, which are not under the control of JAHUAPACHA S.A. and/or ANDANDO TOURS. In price quotations for special programs, and others, not published, JAHUAPACHA S.A. and/or ANDANDO TOURS and/or its affiliates will only recognize those given to the client in writing and will apply them only for the term stated in said quotation.

MEDICAL CONDITIONS:

Upon reservation of our services the customer must inform, in writing, of any special medical condition, temporary or permanent disability, physical disability and/or any preexistent illness that may require special attention or treatment. JAHUAPACHA S.A. and/or ANDANDO TOURS reserve the right to decline any reservation if it considers that the medical impediment could put the passenger at risk during the voyage.

JAHUAPACHA S.A. and/or ANDANDO TOURS and will not be held responsible for any problem originating as a consequence of a medical condition and/or disability the passenger(s) may have during the activities. For this reason it is important that every passenger have his/her own medical insurance.

JAHUAPACHA S.A. and/or ANDANDO TOURS and hold civil responsibility and accident insurance for passengers in so far that they are using the services provided or sold by JAHUAPACHA S.A. and/or ANDANDO TOURS.

SERVICES:

In case of 'events of force majeure', such as: changes in government regulations, passenger safety concerns, climate problems, disturbances, or any other situation(s) that may attempt against the well being of the passengers and/or their belongings and/or the complete fulfillment of our services, JAHUAPACHA S.A. and/or ANDANDO TOURS will provide a detailed explanation to its clients and, at the same time, will offer similar or equal alternatives, maintaining, as always, the same quality service.

The passenger is then entitled to choose between any of the alternatives offered, or request a reimbursement of his/her money with no additional compensation or fee, under the terms and conditions feasible to the company.

ITINERARIES:

Regular itineraries for our programs and/or services are published within our brochures and website. However, in the instance of 'events of force majeure' such as: changes in regulation enforced by the National Parks, Natural Reserves, the Government, climate changes, disturbances or any other situation that may threaten the physical safety of our passengers and/or their belongings, the itineraries published may be altered or changed trying, as much as possible, to keep the same number of visits to similar or equal places and maintaining the same quality in our service. Additional costs generated due to these unexpected changes in the itinerary, caused by 'events of force majeure' are not included. In this case, we will inform our passengers of these changes as quickly as the circumstances will allow us. If a major change is necessary, the passenger may decide between accepting the change by choosing any of the alternatives JAHUAPACHA S.A. and/or ANDANDO TOURS offers or may request a reimbursement of his/her money under the terms and conditions feasible to the company.

COMPLAINTS:

If any passenger is dissatisfied with the service given or sold by JAHUAPACHA S.A. and/or ANDANDO TOURS, he/she must communicate this matter to the guide in charge of the group, who will try to solve the problem immediately. If the problem persists, the passenger must register it on our "comments card" and if he/she deems it necessary to receive an explanation [on the matter] from the operator, the claim must be placed in writing and handed to the company that sold the service in no later than 30 days after the voyage has concluded.

INSURANCE:

Descriptions of the insurance applicable to the tourist activities described in this contract are as follows:

Personal injury insurance for passengers of JAHUAPACHA S.A. and/or ANDANDO TOURS:

Accidental Death: US$ 30,000.00 /person

Total and Permanent Disability: US$ 30,000.00 /person

Medical Expenses: US$ 3,000.00 /person

Ambulance: US$ 150.00 /person

Civil responsabillity

The insurance previously described, with its due coverage, represents all of the insurance JAHUAPACHA S.A. and/or ANDANDO TOURS have contracted. The passenger declares knowledge of this coverage and has agreed to it.

PERSONAL INFORMATION REQUIRED

At least 8 days prior to departure it is important that the following passenger information is provided:

Complete First and Last Name, passport number, nationality (in case of minors provide a copy of the passport), native tongue, birth date, medical conditions, disabilities, special diets, medication(s), allergies, name and phone number of an emergency contact person and the name of the passenger's hotel in Ecuador. In the case where a passenger is not of average size (weight or height), this particular matter must be communicated to JAHUAPACHA S.A. and/or ANDANDO TOURS in order to take this matter into account and offer the passenger every facility possible.

Note:

JAHUAPACHA S.A. and/or ANDANDO TOURS and/or affiliates will make its best effort to please passengers with their required diets; however, if this is not possible, we will notify the passengers in advance.

PAYMENT AND CANCELATION RULES

Once an individual traveller has made a request, JAHUAPACHA S.A. and/or ANDANDO TOURS follows this procedure:

1.- The booking will be valid once JAHUAPACHA S.A. and/or ANDANDO TOURS sends a written confirmation, giving you a time limit to confirm this space.

2.- JAHUAPACHA S.A. and/or ANDANDO TOURS reservation system automatically cancels all overdue bookings.

3.- Once the reservation has been confirmed, you have one week to send us a 10% deposit to reconfirm the booking.

4.- Full payment is required 24 hours prior to the activity.

5.- If a space is cancelled 72 hours prior to the activity there would be no cancellation fee.

6.- If the cancellation is done between the 72 hours prior to the activity and the day of the activity, the 10% deposit will be charged as cancellation fee.

7.- If the activity included a hotel reservation, a no show fee will be charged.

TÉRMINOS Y CONDICIONES GENERALES

Los términos y condiciones generales descritos en este documento se aplican a todos los servicios, viajes y programas en tierra contratados con JAHUAPACHA S.A. y/o ANDANDO TOURS.

Estos términos y condiciones generales se aplican también a servicios prestados por cualquier tercero que sean vendidos por JAHUAPACHA S.A. y/o ANDANDO TOURS.

El usuario de los servicios que son provistos por JAHUAPACHA S.A. y/o ANDANDO TOURS debe cumplir con los términos y condiciones descritos en este documento y en cualquier actualización publicada en el sitio web www.jahuapacha.com bajo la sección "CONDICIONES GENERALES", las que prevalecerán sobre cualquier otra. Se entiende que los usuarios de los servicios de JAHUAPACHA S.A. y/o ANDANDO TOURS declaran que han leído y entendido esta sección y por lo tanto el/ella expresamente aceptan los términos y condiciones generales contenidos en este documento.

PRECIOS:

Las tarifas incluidas en nuestra lista de precios son válidas hasta el 31 de diciembre de cada año en el que se prestaran los servicios, e incluyen solamente los servicios especificados dentro de ellos. Pueden ser aplicables algunos precios excepcionales durante la temporada baja y/o por descuentos especiales.

JAHUAPACHA S.A. y/o ANDANDO TOURS se reserva el derecho a cambiar/modificar las tarifas en caso de eventos de incidencia alta en nuestros costos tales como un incremento en el precio de los combustibles y/o cambios significantes en impuestos y/o en las condiciones laborales, que no estén bajo control de JAHUAPACHA S.A. y/o ANDANDO TOURS.

En las cotizaciones de precios para programas especiales y otros, no publicados, JAHUAPACHA S.A. y/o ANDANDO TOURS solamente reconocerá aquellos que se han otorgado por escrito y serán aplicables única y exclusivamente a los términos establecidos en la citada cotización.

CONDICIONES MÉDICAS:

En la reservación de nuestros servicios, el Cliente deberá informar, por escrito, de cualquier condición médica especial, incapacidad temporal o permanente, incapacidad física y/o cualquier enfermedad preexistente que podría requerir atención especial o tratamiento especial. JAHUAPACHA S.A. y/o ANDANDO TOURS se reserva el derecho a cancelar cualquier reservación si considera que el impedimento médico podría poner en algún riesgo al pasajero durante el viaje.

JAHUAPACHA S.A. y/o ANDANDO TOURS no asumirá ninguna responsabilidad por ningún problema originado como una consecuencia de las condiciones médicas y/o incapacidad del pasajero que le puedan sobrevenir durante las actividades. Por esto es muy importante que cada pasajero cuente con su propio seguro médico.

JAHUAPACHA S.A. y/o ANDANDO TOURS mantiene un seguro de responsabilidad civil y de accidentes para los pasajeros mientras estos estén en uso de los servicios que provea o que sean vendidos por JAHUAPACHA S.A. y/o ANDANDO TOURS.

SERVICIOS:

En caso de fuerza mayor como: cambio en las disposiciones gubernamentales; seguridad de los pasajeros, por problemas de clima, disturbios, u otras situaciones que puedan atentar contra la integridad física de los pasajeros y/o sus pertenencias y/o el perfecto desenvolvimiento de nuestro servicio, JAHUAPACHA S.A. y/o ANDANDO TOURS junto con dar una explicación detallada al cliente y al pasajero, le proporcionará alternativas similares o iguales de servicio, manteniendo siempre la misma calidad, pudiendo entonces el pasajero elegir entre: aceptar cualquiera de las alternativas que le ofrezca JAHUAPACHA S.A. y/o ANDANDO TOURS o recibir una devolución del dinero pagado, sin valores adicionales de indemnización ni otro concepto, en los términos y condiciones factibles para la empresa.

ITINERARIOS:

Los itinerarios regulares de los programas y servicios están publicados en nuestros catálogos y pagina web; sin embargo, si por fuerza mayor como: cambio en las regulaciones de los parques nacionales y/o reservas naturales , o gubernamentales; seguridad de los pasajeros por problemas de clima, disturbios, u otras situaciones que puedan atentar contra la integridad física de los pasajeros y/o sus pertenencias, los itinerarios pueden ser alterados, tratando en lo posible de entregar la misma cantidad de visitas, a sitios similares o iguales y manteniendo siempre la misma calidad de servicio. Los costos adicionales debido a los cambios inesperados en su itinerario por razones más allá de nuestro control, no están incluidos. De darse, los cambios serán puestos en conocimiento del cliente y de los pasajeros con la anticipación que permita las circunstancias. Sí el cambio realizado es de mucha importancia, el pasajero puede elegir entre: aceptar el cambio, aceptar cualquiera de las alternativas que le ofrezca JAHUAPACHA S.A. y/o ANDANDO TOURS o recibir la devolución del dinero pagado, sin valores adicionales de indemnización ni otro concepto, en los términos y condiciones factibles para la empresa.

RECLAMOS:

Cualquiera insatisfacción que los pasajeros tengan mientras están recibiendo un servicio proporcionado o vendido por JAHUAPACHA S.A. y/o ANDANDO TOURS, deberá ser comunicada al guía responsable del grupo, quien tratará de solventar el inconveniente en forma inmediata. Si el problema subsiste, éste debe ser registrado en nuestro comment card, y si considerasen necesario una explicación de parte del operador, esta solicitud deberá ser entregada, por escrito, en un plazo no mayor de 30 días posterior a su viaje.

SEGUROS:

El detalle de los seguros aplicables a la actividad turística descrita en este contrato es el siguiente:

Accidentes Personales para pasajeros de JAHUAPACHA S.A. Y/O ANDANDO TOURSy/o ANDANDO TOURS y/o sus filiales:

Muerte Accidental: US$ 30,000.00 c/u

Invalidez Total y Permanente: US$ 30,000.00 c/u

Gastos Médicos: US$ 3,000.00 c/u

Ambulancia: US$ 150.00 c/u

Responsabilidad civil

Los seguros antes descritos con sus respectivas coberturas, son todos los seguros con los que cuentan JAHUAPACHA S.A. y/o ANDANDO TOURS. El cliente declara conocer estas coberturas y por sus propios derechos y en representación de sus clientes, manifiesta su conformidad y aceptación, renunciando expresamente a cualquier posible reclamación adicional a aquella que se encuentra detallada en esta cláusula.

INFORMACIÓN PERSONAL

Es requisito indispensable para que pueda entregarse los servicios adquiridos, contar con la siguiente información de los pasajeros, en un plazo máximo de 8 días antes de la salida:

Nombres completos, número de pasaporte, nacionalidad - en caso de niños se requiere copia del pasaporte-, idioma materno, fecha de nacimiento; condiciones médicas, incapacidades, dietas especiales, medicación, alergias; persona de contacto y teléfono en caso de emergencias; hotel (para contacto en caso de ser requerido). En caso que el pasajero presente medidas (peso o altura) fuera del promedio, esto debe ser notificado a JAHUAPACHA S.A. y/o ANDANDO TOURS, para que se tomen las medidas del caso a fin de proporcionar las mejores facilidades a los pasajeros.

Nota:

JAHUAPACHA S.A. y/o ANDANDO TOURS hará su mayor esfuerzo para complacer las dietas requeridas, y si esto no fuera posible, el cliente será notificado previamente. En caso de aceptación o silencio en relación a la notificación referida, el hecho no generará obligación alguna de parte de JAHUAPACHA S.A. y/o ANDANDO TOURS ni con el cliente, ni con el pasajero.

REGLAS APLICABLES AL PAGO Y CANCELACIÓN

El pago y la cancelación de reservas, se somete a las siguientes reglas:

1. Las reservaciones serán validas el momento en que JAHUAPACHA S.A. y/o ANDANDO TOURS confirme por escrito, dando una fecha límite para la confirmación del mismo.

2. El sistema de reservaciones de JAHUAPACHA S.A. y/o ANDANDO TOURS cancela automáticamente todo bloqueo vencido.

3. A partir de la confirmación de espacios se requerirá un depósito del 10% en un plazo máximo de una semana para garantizar la reservación.

4. Con un mínimo de 24 horas de anticipación del viaje se requiere el pago total.

5. Si un espacio es cancelado a partir de la reconfirmación hasta 72 horas antes del viaje, no tendrá costo.

6. Si la cancelación se realiza posterior a 72 horas antes del viaje, se cobrará el 10% de depósito como cargo de cancelación.

7. En caso de que el programa contenga la estadía en un hotel, se cobrara el cargo por no show
